Warm wishes for a happy new beginning, Happy New 2023! We have all been through a couple of years of COVID, political turmoil, inflation, and soaring healthcare cost that is reaching the roof.If I have learned anything, it is mainly how to endure, sustain, and stay as positive as possible. As a result, this year, I am finding myself with a fresh load of hope and, more vital, a nagging skepticism and cynicism enough to weather whatever surprises 2023 has to pile on. I ask you to join me in this mystery of surprises and possible fruitfulness.2023 will undoubtedly be another year of ups and downs for us. The healthcare industry's direction has altered how many consumers are in the broad market. Nevertheless, most of us hope that the New Year will bring a new beginning for a positive, healthy year and hope for a fresh wave of energy and willingness to manifest and jumpstart new habits. Regardless of what we included on our vision board for the year, most of us hope to incorporate exercises or walks into our week, spend more time with our family, less time on social media, or actually finally finish watching the movie we started last year. Whatever our goals are for 2023,  we're here to support you! It is essential to mention that this last renewal brought a hike in our health insurance premiums in ways we have never seen before. Encouraging you to review your policy once again and see if you or your family qualify for a subsidy under Covered CA will be crucial. Learning about the new regulation and the 'Fixing of the Family Glitch' will also be helpful. We officially have until the end of this month, 01/31/23, while the market is still open to renew or change our policies for 2023. The Individuals open market will be closed until 2024 unless you qualify for a special enrollment or Qualifying event. I just flew home from a benefits conference in New Orleans while leading two-morning group meditation sessions. All conversations and discussions were around the cost and what type of solutions we can create to access the best care at a lower cost. While no 1 solution fits all, it is clear that there is a powerful solution that fits all. For employers collecting the data and understanding where the potential health issues are developing is crucial. For individuals, taking action towards understanding and navigating the best outcome for their health is vital. Covered CA

Updated Federal Public Charge Policy went into effect on December 23, 2022

"Public charge" is a term to describe someone who is heavily dependent on government assistance or "public benefits".

In the Fall of this year,

" determinations, which took effect on December 23, 2022. The final rule restores previous policies when defining the use of "public benefits", including the exclusion of Medi-Cal programs in that definition, except for long-term institutionalized care. In addition, health coverage and financial assistance through Covered California are also not considered a "public benefit".

Accordingly, obtaining health coverage through Covered California or most Medi-Cal programs will 

not 

make you a "public charge". It will not affect your immigration status, your chances of becoming a lawful permanent resident, or your chances of becoming a naturalized citizen. – This is very important for so many of our clients!

Because the rule may affect you differently based on your unique situation, you should consult with us.

Extension of the National COVID-19 Public Health Emergency – is now 

extended to 04/11/2023

The U.S. Department of Health and Human Services (HHS) has extended the national COVID Public Health Emergency (PHE) an additional 90 days through April 11, 2023.

*** With The COVID-19 Public Health Emergency, you can enroll and change your policy based on the "Public Health Emergency" Qualifying Life Event.

IRS Form 1095-A

It is tax season;

 you will receive a federal IRS Form 1095-A Health Insurance Marketplace Statement, a critical Federal tax document that serves as proof of Minimum Essential Coverage and allows you to claim the premium tax credit.

Therefore, It is crucial to save it and share it with your accountant to reconcile any Advanced Premium Tax Credit (APTC) received and to file an accurate tax return for the 2022 tax year.

The amount displayed on IRS Form 1095-A reflects how much was paid, and for Covered CA clients, to figure out the cost of your health coverage.

IRS Form 1095-A is generated for each enrolled plan (except minimum coverage plans), regardless of if APTC was applied. If you changed plans or had a gap in coverage at any point in 2022, you may receive multiple 1095-A forms.

Important Information:

  • You will receive IRS 1095-A forms by January 31, 2023.

  • If your communication preference is email, you will receive it through email

  • Employees will receive the form from their Employer

  • If your communication preference is mail, you will receive your forms in the mail – some may arrive after January 31.

  • For Covered CA - You can access your IRS Form 1095-A from your CalHEERS account Home Page or under Documents & Correspondence, even if you prefer mail.

New in Benefit Year 2023: Parent and Step-parent as Dependents

Effective January 1, 2023, there is a new definition of “dependent” under California law for the purposes of enrollment in a Qualified Health Plan (QHP), to include a parent or step-parent that you might have.

Long-Term Care & 401K

Congress Passes End-of-Year Omnibus That Includes NAHU- (the organization that I volunteer in) and Supported Provisions

Today

, Congress passed a $1.7 trillion omnibus package to avert a government shutdown. The massive spending package includes two major NAHU-supported telehealth and long-term care provisions. First, you can now 

use existing retirement accounts to pay for long-term insurance

. More specifically, the provision will permit you to pay up to $2,500 yearly for long-term care insurance with your 401(k)s, 403(b)s, and IRAs without a 10 percent early withdrawal penalty tax. Please remember that Long-Term care in a specific tax situation 

is a Pre-Tax policy.

Mental Health

New regulation - The omnibus bill includes $1.5 billion in state grants for substance abuse prevention and treatment and several vital investments to expand access to mental health! This is super important! Mental Health Matter! Including grants for maternal mental health, the Community Health Service Block Grants, and the Substance Use and Prevention, Treatment, and Recovery Block Grants.
